Layr Protec – Terms & Conditions (Terms of Use)

Welcome to Layr Protec ("Application," "App," or "Service"). These Terms & Conditions ("Terms") are a legal agreement between you ("User," "Inspector," "Admin," or "You") and Layr Protec, LLC ("Layr Protec," "Service Provider," "We," or "Us").

By downloading, installing, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, you must not use the Application.

1. Description of the Application

Layr Protec provides tools for property inspections, verification checkpoints (QR, GPS, Bluetooth), uploading photos or videos, generating inspection reports, AI-powered condition assessment, incident logging, and account-level dashboards for authorized property owners, managers, inspectors, or administrators.

The Application may require access to:

• Camera
• Location services (GPS/BLE)
• Photo library
• Internet connection
• Device storage
• Push notifications

Use of these features is governed by these Terms and our Privacy Policy.

2. Eligibility & User Accounts

2.1 Eligibility

You must:

• Be at least 18 years old, and
• Have legal capacity to enter into these Terms.

2.2 Authorized Use

You agree that:

• You will only use Layr Protec for lawful and authorized inspection activity.
• You will not falsify data, impersonate another user, or misrepresent inspection results.
• You are responsible for keeping your login credentials secure.
• If you are using Layr Protec on behalf of a company or property, you confirm that you are authorized to do so.

We may suspend or terminate accounts that violate these Terms.

3. User Data & Content

3.1 Types of Data

The Application may collect, store, and process:

• Inspection results
• Photos, videos, or media you upload
• GPS/QR/BLE verification data
• Notes, comments, condition ratings
• AI-generated observations
• Device/IP information
• Account and profile information

3.2 Ownership of Content

You retain ownership of the content you submit. However, by using the Application, you grant Layr Protec a non-exclusive, worldwide, royalty-free license to:

• Store, process, and display your content
• Generate reports
• Improve inspection accuracy and detection
• Use anonymized data for analytics, AI training, and quality improvement

We do not sell personal data.

3.3 Accuracy of Information

You are solely responsible for ensuring the accuracy and integrity of the inspection data you provide.

Layr Protec does not guarantee:

• The completeness of an inspection
• The accuracy of any AI-powered detection
• That inspections identify all hazards

This Application is a tool and does not replace professional judgment or licensed inspections where legally required.

4. Permissions, Device Requirements & Conduct

4.1 Device Responsibility

You are responsible for:

• Maintaining your device
• Keeping it charged
• Ensuring network connectivity
• Preventing unauthorized access

We are not responsible for failures resulting from device issues.

4.2 Prohibited Conduct

You may not:

• Copy, modify, reverse engineer, or attempt to extract the source code
• Resell or redistribute the Application
• Upload malicious content or disrupt the Application
• Attempt to bypass GPS/BLE/QR verification measures
• Use the Application for illegal activity

5. Third-Party Services

The Application uses third-party tools, including but not limited to:

• Google Play Services
• Firebase Crashlytics
• Firebase Authentication
• Cloud Storage Providers (AWS, DigitalOcean, Firebase Storage, etc.)

These providers have their own Terms & Conditions, which you agree to by using the Application.

6. Internet Connectivity & Carrier Charges

Some features require an active internet connection. Layr Protec is not responsible for:

• Connectivity failures
• Mobile carrier fees
• Data usage or roaming charges

You are responsible for ensuring your connection and for any costs incurred.

7. Subscriptions, Billing & Payments

(Include this even if billing is added later.)

If the Application offers paid plans or subscriptions:

• Pricing will be displayed in-app or on the website.
• Apple/Google may manage billing depending on platform rules.
• Subscriptions may automatically renew unless canceled.
• Refunds follow Apple's and Google's policies—not Layr Protec's.
• If you subscribe through a third-party invoice, contract terms apply.

8. Updates, Modifications & Termination

We may release updates to improve features or security. You agree to:

• Download and install updates when available
• Accept changes to functionality

We may modify or discontinue the Application at any time. If terminated:

(a) your right to use the Application ends;

(b) you must delete it from your device.

9. Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

Layr Protec does not guarantee:

• That all property issues will be identified
• That AI assessments are error-free
• That the App will always operate without interruption
• That data will never be lost

You assume all risk associated with your use of the Application.

10. Limitation of Liability

To the fullest extent permitted by law:

Layr Protec is not liable for any:

• Property damage
• Loss of data, profits, or revenue
• Inspection inaccuracies
• AI misclassifications
• Business interruption
• Security breaches caused by user devices
• Reliance on inspection results or reports

Total liability is limited to the amount you paid to use the Service in the past 12 months (if any).

11. Indemnification

You agree to indemnify and hold harmless Layr Protec, its owners, employees, and affiliates from any claims, losses, or damages arising from:

• Your use or misuse of the Application
• Violation of these Terms
• Uploading incorrect, illegal, or harmful content
• Misrepresentation during inspections

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law provisions.

Any disputes shall be handled exclusively in courts located in Palm Beach County, Florida.

13. Changes to These Terms

We may update these Terms at any time. Updates will be posted within the Application or on our website.

Continued use of the Application constitutes acceptance of the modified Terms.
